Cabinet approves draft of Road Transport Act with highest 5 years jail

The government has given the final approval to the draft of Road Transport Act in the midst of students’ movement demanding safe roads.

The draft of Road Transport Act was approved in the cabinet meeting on Monday.

According to the new law, the case will be filed under section 304 (b) of the criminal procedure if anybody is seriously injured or dead due to negligence or reckless driving.

The punishment is highest five years imprisonment or fines or both and the highest fine will be five lakh taka. In the current law there is provision for highest three years imprisonment as punishment.

Cabinet Secretary Mohammad Shafiul Alam briefed the newsmen after the cabinet meeting.

In section 6 of the law it is said, age should be at least 18 for obtaining license. In case of professional it should be 21. To get license candidates must have minimum qualification of class eight or equivalent class passing.

In the section 11 it is mentioned, there will be 12 points against the license of a driver. One point will be cut from that if the driver commits a crime. His license will be cancelled if the point turns into zero.

In the section 12 it is said, license of a driver will be cancelled or withdrawn if he is physically disabled, mentally deranged or drunk.

According to the new road transport law work hours will be fixed for the transport drivers, helpers and associated workers. It is not in the gazette. Government will fix the work hours keeping similarity with Labor Law 2006.

In the new sections of the law the matters of registration number of the vehicles, area fixation, economic life of vehicle, speed limit and sound limit were included.

Besides, the matters of financial assistance fund for the victims of accidents were included in the law. Though there are provisions for punishment for driving without license in the law but if there is allegation of criminal case or death due to accident then trial will go under criminal procedures.

In 2013 the decision of ratification and reformation of the Motor Vehicle Ordinance of 1983 was taken. After that on March 27 last year the law was ethically approved with some observations in the cabinet meeting.

The Road Transport Act was sent to law ministry for opinion and then they formed a committee consisting legislative and parliament affairs Secretary as its convener after reviewing the provision of crime and punishment of the draft act.

The draft of the Road Transport Act was finalized keeping the committee report same. The act will be passed in the parliament.
