Can transgender person be MP in reserved women seats?

Eight transgender persons have collected nomination papers for reserved women seats in the eleventh national parliament. But question has arisen whether they can be Member of Parliament (MP) in the reserved seats.

After conversation with the law experts it is known, according to our constitution there is no scope to make any transgender person as a woman MP. In the latest amendment of the constitution it is mentioned in the section 65 (1) 3 that in the parliament 50 seats will be reserved for the women members. Even there is nothing mentioned in the Representation of the Peoples’ Order (RPO) about the transgender person.

The experts said, it is not possible to make any transgender person as MP in the reserved seats by not amending the constitution. As there is no scope, so selling nomination papers to them was not worthy.

Former law minister Barrister Shafique Ahmed said, it is said in the constitution that only women can be MPs in the reserved seats in the parliament. For this reason there is no scope for persons with other gender to be members in these seats.

He said, if a transgender person is listed as woman voter, then she will be considered as woman not as transgender.

In this regard Attorney General Mahbubey Alam said, it is a critical question. If a transgender person claims her as a woman then there will be no problem.

Awami League joint general secretary Mahbubul Alam Hanif told Rtv online that nomination papers are on sale. The matter of legal complexities will come in front during the process of finalizing the nomination.

Mentionable, eight transgender persons including Falguni from Chattogram, Nadira Khanam from Rangpur, Arifa Yesmin Moyuri from Mymensingh and Wahidul Islam Parbati from Dhaka have collected and submitted the nomination papers for Awami League.
